Raphael LLC has defended its clients against a number of claims including alleged violations of TILA, RESPA, FDCPA, FDCPA, FCRA, ECOA, HOEPA, the Fair Housing Act, state unfair and deceptive practices statutes (UDAP), privacy laws and the common law. Raphael LLC also handles challenges to our clients’ practices in particular areas, including loan origination, servicing, bankruptcy, collections and loan foreclosure. - Defended financial institutions including Bank of America, First Tennessee Bank, Option One, and Urban Lending Solutions, LLC in state and federal courts throughout the United States and successfully represented Bank of America in appellate matters before the First Circuit.
- Represented John Hancock/ Manulife Financial in interpleader and defense work.
- Responded to subpoenas and provided general commercial litigation services to CIFSC Asset Management.
- Defended generic drug manufacturers in contract disputes and products liability actions across several jurisdictions.
- Represented local corporations including Pilgrim Innovative Plastics and Plymouth Boat Yard in business disputes.
- Represented managers of large commercial farming LLC and real estate LLC in derivative action in Massachusetts Superior Court.
- Represented police officers in dispute with the City of Worcester related to malpractice and conflicts of interest in a high-profile civil rights trial.
- Served as general counsel to New England Horsemen’s Benevolent and Protective Association.
- Represented multiple restaurants including Precinct 10, Stockholders, and The Inn at Bay Pointe in contract and employment matters.
- Represented restaurant corporation in consumer finance litigation related to Chapter 11 Bankruptcy.
- Provided pro bono representation to Tyrone Clark, who was wrongly convicted of kidnapping and rape in 1970s; secured his exoneration through the Massachusetts Superior Court; and filed §1983 action on his behalf in the District of Massachusetts.
- Represented partner and former CFO of venture capital firm in contract dispute with employer.
- Represented individuals in a variety of civil actions related to employment contracts, property rights, business disputes, undue influence and/or capacity with regards to estate planning, breaches of fiduciary duty, etc.
